General Terms and Conditions

The General Terms and Conditions govern the relationships between the landlord of recreational facilities Charming Cottages providing holiday rental stays (hereinafter referred to as the Landlord) and participants in holiday rental stays, clients of the company AMMO Servis s.r.o. (hereinafter referred to as the "Client") The above natural persons or legal entities are entering into a business relationship in accordance with the relevant provisions of generally binding legal regulations of the CR, such as the Commercial Code, the Civil Code and other. Mutual relations are further governed by the following General Terms and Conditions of the company AMMO Servis s.r.o. and these are binding on all parties.  

Article I Introductory provisions - establishment of the contractual relationship

1. The contractual relationship between the company AMMO Servis s.r.o. and the Client arises on the basis of the confirmed order of the holiday stay by the Landlord.

2. AMMO Service s.r.o. provides accommodation services only to clients over 18 years of age. Persons under 18 years of age can use these services only through persons over 18 years of age.

3. The Client who has ordered the stay in the form of a binding order  of the stay and entered into the contractual relationship with the Landlord will be liable for obligations of other persons participating in the holiday rental stay.

4. AMMO Services s.r.o. undertakes to use personal data obtained from clients and landlords solely for internal purposes relating to stays. Information about customers and landlords is processed in accordance with Act No. 101 / 2000 Coll. on protection of personal data and the Parties agree to it.

Article II Orders of stays

1. Client - The binding order of stay

i. The binding order of stay shall be made in writing (the form is available in electronic form on the website Kouzelné chaloupky.cz). In his order the Client will select the cottage, the date, the total number of persons (divided into adults and children,specifying the children's age in a note) and give information whether he requires to take a pet with him for the stay. The Client will also give his contact details and send this order to the Landlord by clicking on the "Order" button directly in the order form on the website www Kouzelné chaloupky.cz.  Before placing an order the Client is required to consent to these Terms and Conditions - without this consent the order will not be delivered to the Landlord.

ii. In the event that the required date in a given accommodation facility is free, AMMO Servis will send to the Client confirmation of the order of the stay, in which it will specify the exact terms of payment and book the stay for the period specified in the order confirmation (usually 3 to 5 working days). The Client will transfer during this period an advance payment for accommodation (50% of the total price for the stay) to the Landlord's account.

iii. After receipt of the advance payment the Landlord will make a binding booking of the date and at the same time will issue and send (usually by e-mail) the Confirmation of money received o the Client's address 

iv. In the case of invoicing the amount of the total price for the stay, the advance payment is not required. The accommodation facility will be bindingly booked and contact details handed over after the amount of the total price for the stay as per the invoice is transferred to the Landlord's account.  The Client is obliged to specify the requirement to pay for the stay by an invoice already in the Binding order of the stay, in which case it is also necessary to give in the order the Client's complete invoicing data that are to be used in the invoice issued.

Article III Length of stays

1. The length of stays in high season is usually one week  (normally from Saturday to Saturday). Seasonal dates are listed on the website Kouzelné chaloupky.cz

2. Weekend stays (usually from Friday to Sunday) or long weekends are possible during the off season.

3. However in high season in winter it is possible to arrange a stay for less than a week, with a minimum of 4 nights. 

4. The accommodation facility will be taken over on the stay start date usually between 2 p.m. and 5 p.m. The accommodation facility will be handed over and the stay ended on the last day of its rental by 10 a.m., unless the Client and the Landlord agree otherwise.

Article IV Prices and payments

1. The rental prices have been agreed by mutual consent under Act No. 526/1992 Coll. on prices. The prices are stated in the offer on the website inclusive of VAT. The prices have been determined per the facility and per night regardless of the number of people accommodated. However, at the same time the maximum number of persons accommodated in a given facility has been determined.

2. The price is inclusive of the electricity consumed and for the New Year's stay also includes the cost of heating. During the off season and weekend stays an extra fee for heating  CZK 200, - (weekend) or CZK 400,  (stay longer than 3 days) is charged.

3. The price of stays od 7 days also includes the basic cleaning. It is exclusive of washing dishes, cleaning the refrigerator and the microwave oven from leftover food etc., or serious soiling of the cottage (dirt, clients not changing their shoes, very dirty linen, dirty walls, etc.). The cost of removal of such dirt will be charged at the rate of CZK 150, - per hour of work and recovered from the Client  (or deducted from the refundable deposit). For stay of 6 or less days the cleaning cost will be charged of 500,- CZK.

4. The advance payment for accommodation needs to be transferred to the Landlord's account within 5 working days after the order confirmation. For stays with an early start date, this time limit for transferring the advance payment for accommodation can be reduced as appropriate, or the full accommodation cost can be paid to the Landlord only upon commencement of the stay. Information sent by confirmation email and then information contained in the voucher are decisive for transferring the advance payment for accommodation. The complementary payment of the price for accommodation will be transferred to the Landlord's account 1 week before commencement of the stay or if the time from the date of arranging the stay is less than 1 week then in cash upon commencement of stay. After receiving the final payment the Landlord will issue the VOUCHER with all particulars. The voucher will contain the name of the accommodation facility, the exact date of stay, the number of persons accommodated, the amount of payment due to the Landlord for accommodation (including information on the amount of any advance payment of this amount requested by the Landlord to be transferred in advance), precise contact information of the Landlord and other specific details of the stay. 

5. The due date for transferring the advance payment for accommodation to the Landlord is binding on the clients.

Any non-compliance with the payment requirements (amount, due date, etc.) constitutes the Client's breach of the contract for a given Order of stay.

6. For some dates, on arrival the payment of refundable deposit, usually in the amount of CZK 1,000 to CZK 5,000 is required. This deposit will be returned to the Client upon departure, unless the Landlord's property has been damaged.

Article VI Cancellation of the stay by the Client

1. The Client may cancel the stay for serious reasons and only in writing and the contract is rescinded upon delivery of this document/communication to the Landlord.

2. In the case of rescission of the contract within 60 or more days after the ordered start date of the stay, the Client is obliged to pay to the Landlord the cancellation charges (except for generally accepted reasons for rescission of the contract) in the amount of:

i.    60 or more days before commencement of stay .................. 20% of the price for accommodation

ii.   59 to 30 days before commencement of stay  ..................  30 % of the price for accommodation

iii.  29 to 15 days before commencement of stay  ..................  50 % of the price for accommodation

iv.  14 to 8 days before commencement of stay  ..................  80 % of the price for accommodation

v.    7 - 0 days before commencement of stay  ..................  100 % of the price for accommodation

3. In the event that the Client finds someone to replace him or agree with the Landlord the option of using any future alternative date for his stay, then the cancellation charges needn't be paid.  

Article VII Cancellation of the stay by the Landlord

1. The Landlord may cancel the stay in serious cases when it is not possible to provide the accommodation due to events such as, for example, natural disasters, other disasters and other unexpected events which could not have been anticipated upon conclusion of the contract and this reason lasts throughout the length of the originally agreed stay. The Landlord will in this case offer the Client an alternative adequate stay, if such stay is available in his offer.

2. If the Client doesn't accept the alternative stay or an adequate alternative stay is not available, he will immediately receive the refund of the advance payment for accommodation from the Landlord, namely to the account number, which the Client will provide to TIPPOBYT or the Landlord for this purpose. The Client is not entitled to require any other compensation.

Article VIII Insurance of the stays

1. The Landlord is not liable to the Client or to the landlord for any damage to movable and immovable property over the period of the holiday rental stay. He is not liable for any damage to health or theft of personal items, either. The suitability of small children's stay in the individual accommodation facilities will be decided by the Client. 

2. Personal insurance and insurance of accommodation facilities, including fixtures and fittings is not included in the price for accommodation. For these reasons, the Landlord recommends to the Client to take out an appropriate insurance policy with any insurance institution to the extent needed.

Article IX Complaint

1. The Client has the right to file a complaint if the services ordered haven't been provided to the full extent or up to the required quality standards .. The complaint must be exercised in writing - in the form of a report. It is not possible to file a complaint in respect of the exact location, condition and range of amenities based on a photo gallery or virtual tour of the facility or its surroundings, these are only for information purposes (as well as it is impossible to guarantee the same climatic conditions during the stay as those that prevailed during photographing or shooting a virtual tour of the facility and its surroundings).

2. The Landlord is responsible for technical and hygienic condition of the facility in accordance with the existing standards. Furthermore, he is responsible for amenities of the facility and the range of services offered as specified in the offer presentation of the facility on the website kouzelnechaloupky.cz.

3. The Client is obliged to notify the Landlord immediately of any shortcomings and defects in order to allow their remedying.     

4. If the Landlord fails to remedy immediately the above shortcomings and defects which entitle the Client to file a complaint, it is necessary to assert these claims from the Landlord directly on the spot, for example in the form of discounts. 

Article X Final Provisions

1. These General Terms and Conditions come into force on 1 January 2012 and are binding on the Landlord and the Client.

2. The Client acknowledges that he has been informed about the wording of the General Terms and Conditions, understands them and agrees to them, which he confirms by his consent in the order of the stay.
